Rodney King is facing misdemeanor drunken driving charges in Riverside.

A few months ago King was pulled over by Moreno Valley Sheriff’s deputies for allegedly committing several traffic violations.  After taking a field sobriety test, King was arrested on suspicion of driving under the influence.  He admitted to using marijuana under a doctor’s care.

King is not in jail and waits for his arraignment in November.  This is not his first time with a DUI arrest; he has been arrested several times for illegal drug use.  He also has a conviction for reckless and impaired driving on his record.

Criminal DUI charges are extremely serious and come with severe consequences.  If you have been arrested for DUI, contact an experienced Riverside Criminal Law attorney who has been successful in alcohol-related cases and will fight for your rights.

According to the California Highway Patrol in Indio, there was a 111 percent increase in the number of DUI-related arrests over the Labor Day weekend.

Police were out and about the Coachella Valley arresting drivers on suspicion of drinking and driving – 19 drivers were arrested this year versus only 9 last year.  The good news, however, was that alcohol-related accidents were down this year.

California Vehicle Code Section 23152(a) and (b) state, “It is a misdemeanor to drive under the influence of alcohol and/or drugs and it is a misdemeanor to drive with .08% or more of alcohol in your blood.”

If you have been arrested for drunk driving, you could be facing serious jail time and fines, depending on prior arrests.  It is in your best interests to contact an experienced Riverside Criminal Law attorney because DUI charges are not only serious, they can be extremely stressful.

A 51-year old man out for a ride on his bicycle the other evening was struck by an oncoming truck and killed.

Investigators are checking to see what happened to cause this fatal accident near an intersection. According to California Vehicle Code Section 21800(a), “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” This includes bicycles because bicyclists in California have the same rights and responsibilities as drivers of other vehicles.

When the results of the investigation are determined and if the driver of the vehicle is determined to be at fault, he or she may be liable for the bicyclist’s wrongful death.  It would be wise for the family of this man to contact a Riverside Personal Injury attorney who has been successful in wrongful death lawsuits. They may be entitled to compensation for expenses, including medical and funeral costs.

You all remember Rodney King from the 1990’s?  He was the driver in Los Angeles that was beaten by four police officers, which led to the famous riot.

Anyway, The Moreno Valley Police Department pulled him over the other day after watching him commit several alleged traffic violations.

He was booked into a local jail for investigation of driving under the influence. His bail was set at $2,500.

Whether this is his first or second DUI offense, he is looking at jail time, fines, license suspension and a mandated program for driving while under the influence.  Apparently, he has struggled over the years with sobriety.  He would be wise to contact a Riverside Criminal Law attorney who is experienced in DUI cases, especially if he is a repeat offender.  The attorney will know how best to represent him.

Who must yield the right-of-way when two vehicles are approaching an intersection?

According to California Vehicle Code Section 21800(a), “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”

If a vehicle runs a red light, under California Vehicle Code Section 21453(a), he or she is facing a serious traffic violation.  The following are a few rules when you must yield the right-of-way at an intersection:

·         Yield sign – slow down or stop.
·         No signs or signals – yield the right-of-way to a vehicle approaching from the right.
·         Stop signs on every corner – yield to the first vehicle that comes to a complete stop.  If 2 vehicles stop at the same time, the vehicle on the left yields to the vehicle on the right.
·         Want to turn left – make sure approaching traffic passes and all is clear.
·         Pedestrians – always yield to a pedestrian.

Remember, signaling does not give you the right-of-way; make sure you have a clear path in front of you before proceeding.

No one should have to pay the price for someone else’s negligence.  If you are injured in an accident where the other driver did not yield the right of way, contact an experienced Riverside County Personal Injury attorney who will get you the compensation you deserve.

If you are stopped for speeding in California, be prepared to pay the highest fine in the country.  The ticket could cost you well over $300 – not to mention higher car insurance premiums.

California Vehicle Code Section 22350 states, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property”.

In addition to very high fines, a speeding ticket puts points on your license.  The points you receive depend on how fast you were driving, if you were following another vehicle too close, if you were driving recklessly or if you were speeding through a construction zone. Depending on how many you receive, your license can be suspended.  Most moving violations stay on your record for at least three years, some longer.

You can fight your speeding ticket.  Take this ticket seriously; don’t just pay it.  Contact an experienced Riverside Criminal Law attorney who will help you fight this ticket and save your driver’s license.  Call an attorney who is familiar with California speeding laws and successful in defending speeding ticket cases.

A 52-year old man and his 50-year old wife were killed in an accident in Temecula the other night.  The accident was caused by a hit-and-run driver.

As they were driving down the road, a vehicle collided head-on with them.  The driver fled the scene, leaving the two to die.  The two victims were pronounced dead at the scene.

The law says that it is illegal to leave the scene of an accident, especially without trying to help any injured parties.  California Vehicle Code Section 20001(a) states, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident”.  In this case, the hit-and-run driver left two people.

Police are looking for the hit-and-run driver and are asking anyone who witnessed this fatal accident to contact them.

If you have a family member that has been killed in a hit-and-run accident, contact an experienced Riverside Personal Injury attorney who will investigate for you and make sure the negligent party is held accountable for your tragic loss.

A 37-year old man was sentenced to 31 years in prison for vehicular manslaughter while intoxicated for crashing into a vehicle stopped at a red light and killing the 18-year old girl in the passenger seat – he fled the scene, but was arrested about 10 hours later.

The impact of the crash pushed the vehicle into a major intersection – causing a chain-reaction crash with several vehicles.

The intoxicated man has two drunken-driving convictions and an alcohol-related reckless-driving conviction.  He pleaded guilty to vehicular manslaughter with gross negligence while intoxicated and admitted several penalty-enhancing allegations for causing bodily injury to several victims.  In addition, it was found that he has a prior felony strike conviction for a previous robbery and three prior convictions for driving under the influence in California and in Washington State.

If you are facing criminal charges for drunk driving, you will need an experienced Riverside Criminal Law attorney – one that knows the law and will fight for your rights.

According to the Riverside County Coroner’s office a 39-year old Palm Desert man who was hit by a utility van in Bermuda Dunes the other day died shortly after the impact. The bicyclist was heading southeast on his bike when the van crashed into him.  He was taken to a nearby hospital with major injuries; he died about 30 minutes later.

According to California law, bicyclists on the road have the same rights and responsibilities as motorists.  They must ride in the same direction as other vehicles and as close to the right curb or edge of the road as practical.

Many bike accidents are caused because of failure to yield the right-of-way to the cyclist, drivers who fail to stop at a red light or stop sign, inattentive driving or driving under the influence.

The accident is under investigation to determine what caused it.  Investigators do not believe alcohol was a factor.  The report did not mention whether or not the bicyclist was wearing a helmet although according to California law, all bicyclists must wear a helmet that meets safety standards.

If you or a loved one was on a bike and injured in an auto accident, you may have a claim against the driver for compensation of medical expenses, pain and suffering and lost wages.  It is important to contact an experienced Riverside County Personal Injury attorney as quickly as possible in case it is necessary to reconstruct the accident to gather essential evidence – an attorney who will fight for you.

A 71-year old man was injured by an SUV that was stolen recently.  The man was driving his pickup truck on Highway 74 when a 48-year old man fled the scene of a disturbance at 100 mph in order to avoid authorities.

The 48-year old man lost control of the SUV while rounding a curve in the road, causing him to drive into oncoming traffic.  He hit the pickup truck head-on.  Both drivers were taken to a local hospital with injuries.

The police are investigating the cause of the accident.  They believe that reckless behavior and excessive speeds contributed to it. California Vehicle Code Section 22350 states, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a s peed which endangers the safety of persons or property”.

I urge the victim and his family to contact an experienced Riverside County Personal Injury attorney who can seek financial compensation for his injuries and expenses that resulted because of another’s reckless behavior.
