A 52-year old freeway worker on a closed-for-construction on-ramp on the westbound 91 Freeway in Riverside has become the fourth highway worker in the last two months to be struck in a freeway accident.  He is in critical condition at a local hospital.

CHP reported that the 21-year old driver was allegedly driving drunk when she flew past the “Road Closed” sign, running over orange cones, hitting a Caterpillar loader and hitting the man.  The driver was hospitalized and will be arrested once she is discharged.

Recently Caltrans launched a “Move Over” safety campaign, placing electronic signs along the freeways that read, “Slow Down or Move Over for Workers; It’s the Law.

For those wondering why their Metrolink train to Los Angeles was delayed the other morning – reports indicate that a male transient was killed by a commuter train in Riverside.

Details of the fatal accident have not been published as yet.  The transit authority, however, would like to remind people that it is never safe to use train tracks for anything other than riding the train.  California Penal Code Section 369i states, “Walking on or within 20 feet of train tracks is a violation”.

A 27-year old Perris man suspected of driving under the influence of alcohol and/or drugs crashed into the back of a vehicle driven by a 63-year old man on Interstate 215 in Riverside in the early morning hours.  If that was not enough, he proceeded to drive the wrong way on the same freeway until he crashed head-on into another vehicle driven by a 23-year old woman.  He was driving between 90 and 100mph.

 

California Highway Patrol officers said he was trapped in the wreckage and suffered major injuries.  An emergency team transported him to a nearby hospital.  The other two drivers suffered minor injuries and were taken to a local hospital.

 

CHP said they will seek drunken driving charges against him.

A cyclist and his girlfriend, who was also on a bike, were waiting at the railroad tracks in Riverside for a train to go by recently.  It was around noontime.

When the train cleared the crossing, the man started across the tracks even though the crossing arms were still down.  He was hit by a train coming from the opposite direction.  Riverside Paramedics treated him at the scene for head wounds and broken bones.  He was then taken by ambulance to a nearby hospital.  He died several hours later.

It is common knowledge that a bike rider who is not careful can get hurt riding over railroad tracks – even if a train is miles away.  A train could be approaching at a high speed from either direction.  A bicyclist must stay alert and watch for trains in both directions in order to stay out of danger and avoid injury.  In this case it was death.

This fatal accident was the third time in less than two years that individual crossed tracks in Riverside after a train passed – only to be hit by a train coming from the other direction on a parallel track.

A Riverside man was arrested after midnight the other night for driving while intoxicated and possession of marijuana when he crashed into a fence and bushes.  He was very lucky that no other vehicles were involved and no other person was injured.

He is out on bail pending a municipal court hearing.  I cannot tell my clients enough times not to drink and drive.  If you must drink, please designate a non-drinking driver to take you home.

A 30-year old man, lost control of his motorcycle in Riverside recently and crashed into a pole.  The impact caused him to be thrown into a street light.  He was transported to a nearby hospital where he was pronounced dead.

 

According to a recent California Highway Patrol report, there were 32 fatalities and close to 600 injuries involving motorcycle accidents in Riverside County.  The accident is under investigation to determine what caused the man to lose control of his motorcycle; investigators are checking to see if alcohol or drugs were involved or if there was a motorcycle product defect.

 

I hope that the man’s family consults with an experienced Personal Injury Attorney who will investigate the incident for them and make sure their rights are protected.  If a defect were found to be at fault, preserving the motorcycle would be in their best interests.

According to The Press-Enterprise, a 31-year old woman and a 43-year old man died after crashing head-on with each other on the Ramona Expressway in Riverside.  The woman, driving a Chevy pickup truck, drifted over the centerline and crashed into an oncoming Toyota driven by the man.  Both died almost immediately.

 

California Highway Patrol records indicate that Riverside County, in 2008, had over 200 fatalities and more than 8,500 injuries due to car accidents.

 

This accident is under investigation to determine what caused it – numerous questions arise.  If the woman was at fault, the family of the man can file a wrongful death claim seeking compensation for expenses and damages.  If the vehicle manufacturer is found to be at fault, they could be responsible for all expenses and damages.  I hope the man’s family contacts an experienced Riverside County Personal Injury attorney who will analyze all details of the accident.  In the meantime, my deepest sympathies go out to the families of the woman and the man.

The Orange County Register reported recently that Riverside prosecutors are investigating a 32-year old man who has been exploiting young girls through Facebook and MySpace for almost two years.

 

He pretended to be a fake modeling agency and asked them to send sexually explicit pictures of themselves.  He sent them pictures showing the poses he wanted them to use.  Dozens of young girls from about 16 states and 2 countries sent him photos – hoping to become a model.  The youngest girl was age 11.  Many actually met with him.

 

A classmate of one of these girls told her mother about the agency.  The mother told the potential model’s mother.  The girls admitted that they posed nude at this man’s home; they were 13 and 14.  He took one of the girls to a home in Palm Springs for pictures.  After taking a few pictures, he told the girl his camera broke.  This girl’s mother was on welfare and got upset when her daughter was not paid.  The man then took this young girl into the shower, had sex with her, and paid her $120.

 

He admitted to “being sick and needing help for his addictionInvestigators confiscated his camera, computers and all types of nudist literature from his home.  He was finally arrested several months ago on 23 counts of kidnapping for the purpose of rape, aggravated sexual assault and lewd acts against children under 14.  Recently, more than 126 counts were filed against him.

 

He is presently in a Riverside jail.

In a recent Orange County Newspaper article, a Riverside woman was charged with a hit-and-run death of a bicyclist in Newport Beach.  The District Attorney’s office said the woman was under the influence of prescription drugs (Methadone and Clonazepam) when her SUV hit a bicyclist in Newport Beach in December.

 

After she hit the man, who was driving near the curb, she fled the scene – dragging his bike under her vehicle for more than a mile.  The man died a day later from severe head and neck injuries. 

 

The woman is charged with one felony count of hit and run with death, one felony count of vehicular manslaughter while intoxicated without gross negligence, and one misdemeanor count of driving without a valid license with a sentencing enhancement for causing great bodily injury.

 

Once again, I urge you not to drink and drive or while taking medication.  This woman needs the help of an experienced Criminal Attorney.

California Penal Code 647(f) - Drunk in public” or “Drunk and Disorderly”, is a misdemeanor crime in Riverside and surrounding counties.  It is illegal to be under the influence of alcohol, drugs, or a controlled substance in public when an individual cannot exercise sufficient care for his or her own safety by falling down or passing out on the street, or making a nuisance of his or herself.

 

A public place is outside of a home.  Examples include public streets, shopping mall, restaurant or Movie Theater – to name a few.

 

An individual convicted of this crime can face up to 6 months of jail time for a first-time offense, probation, alcohol treatment programs, and/or fines.  The conviction will also become part of the individual’s permanent record.  I would suggest anyone arrested for this type of crime to consult an experienced Criminal Defense Attorney immediately.
