A bicyclist, who may have been under the influence of alcohol, according to Cathedral City police, ran a red light the other day and crashed into a vehicle.

In California, there are special laws that handle cycling under the influence.  The California Vehicle Code does not include a bicycle as a “vehicle” for purposes of the California DUI laws.  However, the Code does provide that it is unlawful for any person to ride a bicycle on a highway while under the influence of alcohol or drugs.  Anyone arrested for this violation is required to take a blood, breath or urine test.

A conviction to the California cycling under the influence law is subject to a fine of at least $250.

The bicyclist was taken to a nearby hospital with unspecified injuries, while the driver of the hit vehicle was not injured.

Anyone on the corner of Market Street and Mission Inn Avenue the other morning probably saw a transit bus and semi-truck collide. It was very fortunate that no passengers were on the bus.  However, it was reported that the bus driver and the truck driver sustained non-life-threatening injuries.

Upon investigating, it was determined from a surveillance camera on the bus that the bus had a green light as it approached the intersection.  If this turns out to be true, the truck driver either ran a red light or failed to yield the right-of-way at the intersection.

Based on California Vehicle Code Section 21800(a), “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”  In addition, California Vehicle Code Section 21453(a) states, “Running a red light is also a serious traffic violation.”

I urge the bus driver to consult with an experienced California Personal Injury attorney because if the truck driver is found to be at fault, then he and/or his employer could be liable for the injuries caused and compensation for any medical expenses and damages. A 12-year old girl was killed recently because a 21-year old man, ran a red light.  Not only was this young girl killed, but also her mother and 21-year old brother were badly injured, according to California Highway Patrol officers.

 

The man was arrested for the possibility of driving under the influence.  He broadsided the vehicle that had the three individuals.  The accident is under investigation.  How very sad for this young girl and her family.

 

I would urge the man to contact an experienced Criminal Attorney as soon as possible for the help he will need.  There is a chance he was driving under the influence, but more importantly, a child was killed because of his actions.
