According to Canyon Lake police, a driver was recently arrested on suspicion of driving under the influence after he collided head-on with another vehicle.  The accident injured two people, including the suspected drunk driver.  Both drivers were taken to nearby hospitals with unspecified injuries.

California Vehicle Code Section 23152(a) states, “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Officers are investigating this accident to determine what caused it.  If the suspected drunk driver is found at fault, he can be held liable for injuries caused to the victim.  In addition, he is facing criminal charges.

Another automobile recall has come to our attention.  Chrysler is recalling more than 11,000 cars, minivans and other models because of a manufacturing problem.

The manufacturing problem has the potential to cause the steering to fail.  Dealers will replace any missing parts and align the incorrectly installed ones.

The vehicles being recalled include:
·         Chrysler – Model 200 and 200 convertible, town & Country
·         Dodge – Avenger, Caliber, Grand Caravan, Nitro, Journey
·         Jeep – Compass, Patriot, Wrangler, Liberty

Anyone at the intersection of Alejo Road and Sunrise Way in Palm Springs the other afternoon was probably delayed by the four-vehicle accident that took placed.

 

Four vehicles were involved in an accident; three had to be towed away.  A 29-year old woman was transported to a nearby hospital complaining of leg pain; there were no other injuries reported.

 

Intersections are one of the most dangerous spots on California roads.  Statistics show that at least one-third of vehicle accidents and 40% of all fatalities happen at an intersection.  The most common ‘right-of-way’ rule is that a person turning left should yield the right-of-way to a vehicle approaching from the opposite direction.

 

Local police are investigating to determine the cause of this accident.

In most cases when an individual is involved in an auto accident, he or she panics and doesn’t know what to do first.  The following is a list of things to remember if you are involved in a collision.  Keep it in your wallet or car.

  • Call 911 immediately – check condition of others involved
  • Exchange information with the other person – name, address, telephone number, license number and insurance information
  • Keep a camera in the car or use cell phone to take pictures of damages and injuries
  • If there are witnesses, get their names and phone number
  • Do not give any statement to the other person’s insurance company without your attorney present – cooperate with your insurance company
  • Get medical attention – an injury can always show up later on

The other day, in the middle of the afternoon, in the middle of a busy intersection, a 17-year old boy was hit by an automobile while cycling through the intersection.  The boy was taken to a local hospital where he was treated for non-life threatening injuries.

 

Police are investigating what happened.

 

I hope that the boy will be okay but if something serious turns up, it would be wise for him and his family to seek the advice of an experienced local Personal Injury attorney who will make sure he receives compensation for his medical expenses.

Did you hear about the recent Moreno Valley 3-automobile accident on Cottonwood Avenue where one person was killed and two injured?  It seems the driver of a black Honda was driving erratically – weaving in and out of traffic.  It cut-off or hit a Ford Explorer, causing the Ford to swerve into oncoming traffic, hitting a Nissan minivan head-on.

 

The 54-year old woman driver of the Ford was taken to a local hospital where she died from injuries sustained in the accident.  A male passenger in this vehicle sustained a broken ankle and the male driver of the Nissan complained of chest pains.  They were taken to a local hospital and treated for their injuries.  According to witnesses and investigators, the black Honda fled the scene.

 

Police are still investigating this accident.  They ask anyone with information to contact them at 951-486-6700.  My sympathies go out to the family of the driver of the Ford Explorer, a woman who was in the wrong place at the wrong time.

There are many bicycle riders in the communities surrounding Palm Springs due to the beautiful weather most of the year.  Because of all the riders and all of the vehicles on the streets of Palm Springs, accidents happen.  Even if a bicycle rider is protected with a helmet, he or she does not stand a chance if hit by an automobile or truck.

A night that started out partying and having fun ended when a gang member allegedly stabbed a man and then drove into him and three other people according to the San Bernardino Sheriff’s Department.  The alleged attacker, who is only 22, is being held for attempted murder.

People at the party said the alleged attacker got into an argument with the person giving the party.  The two men went into the parking lot and became physical.  The attacker took out a knife and stabbed the victim at least three times, puncturing the man’s lung.  Afterwards the attacker got into his vehicle, intentionally drove into the victim, and then hit three other people in the parking lot, according to witnesses at the scene.  The victim was flown to Arrowhead Regional Medical Center in Colton; the other three victims were treated for minor injuries.

The definition of hit and run is the crime of failing to stop, identify oneself and exchange the necessary information after a vehicular collision.  A hit and run may carry criminal charges depending on the damages and injuries.  It is the responsibility of every driver to stop when involved in an accident with a pedestrian, a vehicle or someone’s property – according to the California Hit and Run Law. 

 

If you damage a parked vehicle or property and cannot locate the owner, California law requires you to leave a note on the damaged property.  You must include your name, telephone number and facts about the accident.  You must also file a police report.

 

A hit and run is usually considered a misdemeanor.  This is when there are minimal damage and no injuries.  A misdemeanor penalty may carry six months in a county jail, fines and/or victim restitution.  When there is serious bodily injury or death, a felony charge is issued.  Penalties for a felony charge include several years in prison, thousands of dollars in fines, DMV points and/or license suspension.

Recently I overheard a conversation about a woman that slipped in a grocery store.  She hurt her lower back but did not know what to do about it and if she could do anything about it.  I introduced myself and told her I am a personal injury attorney.

 

I asked her if she had inspected the area where she fell – if anything was on the floor in her way, and did anyone see her fall.  She said the floor had some liquid on it and she slipped on that.  She said there were several witnesses and yes, she did get their names and phone numbers.  I asked her if she had spoken to the manager of the store and she said she did report it and he wrote down all the details.  He was not aware of the spill.
