A 74-year old man taking an early morning ride on his bicycle was struck by a pickup truck and killed.

The last person to be killed while riding a bike in Moreno Valley was in 2009.  The accident is under investigation at this time; officials are investigating to determine if the bicyclist or the pickup truck driver was at fault.  Many questions need to be answered before they can determine who was to blame.

If the investigation determines that the truck driver was at fault, he or she could be held responsible for the victim’s wrongful death.  In that case, the family should consult with an experienced Riverside Personal Injury attorney to seek compensation for medical and other related expenses.

A driver crossing the railroad tracks in Riverside the other night was killed when a train struck his vehicle.

After receiving numerous calls, a police helicopter crew found the vehicle embedded in the front of the train.  They were able to extricate the driver before the vehicle burst into flames. The driver was pronounced dead at the scene.

An investigation is being conducted to determine why the vehicle was on the tracks.  It is so important for drivers to take care when crossing railroad tracks and never attempt to drive across when a train is in sight.  Witnesses told police that the crossing arms were operational at the time of this fatal accident.

Railroad accident lawsuits in California are complex; the victim or his or her family must prove that the railroad is liable under the circumstances of the case.  Although trains usually have the right of way, the operator must use reasonable care and keep an eye out for vehicles and/or pedestrians along the way.

If you or a loved one has been involved in a train accident, contact a Riverside Personal Injury attorney who has experience in train accident cases – one who will work hard to get you the best possible results including compensation for any expenses incurred.

An 18-year old boy riding his bike in Norco the other night was hit by a car, causing him to sustain critical injuries; he is in a coma.  He had just spoken to his mother; he was on his way home from his dad’s home – about two blocks away.  Reports state that the two were travelling in opposite directions when the crash took place.

The young boy underwent brain surgery.  In addition, he is sustained a broken leg and pelvis.  He is listed in critical condition.  The woman driving the vehicle that hit him was also taken to the hospital.

His mother says this is the second time in six months that he has been seriously injured – the first time he was walking along a horse trail when he was struck by a hit-and-run driver.  At that time, the doctors put him in a medically-induced coma.

If you are injured while riding your bike by another vehicle, contact an experienced Riverside Personal Injury attorney to determine if you can seek financial compensation for your injuries and expenses.  If the driver is proven to be at-fault, he or she may be held liable for your losses.

Norco Police are investigating to determine what caused the car to strike the bicyclist.  It is unknown if the bicyclist was on the shoulder of the road or if the driver of the vehicle was making a turn or being negligent somehow.

An 87-year old pedestrian was killed in Temecula, by what police say, is a repeat DUI offender.

According to the police, the woman was walking her dog on the sidewalk when a car, driven by a 55-year old man, veered onto the sidewalk and fatally struck them.  The woman was taken to a local hospital where she died.

The driver was driving with a revoked license; he has four previous DUI convictions and was not supposed to be driving.  His vehicle is equipped with an ignition interlock device that detects alcohol but not prescription drugs, which is what he was using.  He was arrested for gross vehicular manslaughter.

Police are investigating to determine what kind of drugs were in his system at the time of the fatal accident.  According to California Vehicle Code Section 23152(a), “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

My thoughts and prayers are with the family and friends of the woman who died.  I urge the family to contact an experienced Riverside County Criminal Law attorney who is successful in DUI cases to file a wrongful death lawsuit so they can be compensated for funeral and medical expenses and the loss of their beloved family member.

A 5-year old Desert Hot Springs boy on a bicycle was trying to cross a street the other night when he got hit by a car.  It’s not clear why his parents were not with him at that time, 10:30 p.m.

Police questioned and released the driver.  They are certain he was not driving under the influence of alcohol or drugs.  It was noted, however, that the young boy was not wearing a helmet.

The child was flown to a nearby hospital where he is listed in serious condition.  The Desert Hot Springs Police are hoping this does not turn into a homicide.

If you are involved in an accident and your actions cause someone to be seriously injured, I suggest you contact an experienced Personal Injury attorney who will protect your legal rights.

A 77-year old woman out for a walk and crossing the road the other evening in Hemet was struck and killed by a minivan.

The police are investigating to determine what happened.  According to reports, there is a crosswalk and a stop sign at the intersection, but it is not clear where the woman was crossing.  If she was indeed, inside the crosswalk, the motorist was required to stop and yield the right-of way to the pedestrian.

California Vehicle Code Section 21950 states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection”. It continues with, “the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian”.

If the investigators determine that the driver of the minivan was at fault, he or she could be held liable for the woman’s wrongful death.

If a family member is killed because of the negligence of another person, contact an experienced Riverside Personal Injury attorney who will protect your rights and seek compensation for medical, funeral and other expenses.

A 25-year old West Covina man was ordered to stand trial on second-degree murder charges after killing two women, ages 75 and 43, on Interstate 10 near Coachella while he was driving drunk.  Three other passengers in the victim’s car were taken to a nearby hospital for minor to moderate injuries.

He was arrested when he tried to run across freeway lanes and came across a dirt embankment which was too steep to cross.   He is facing two felony counts of second-degree murder and one count each of assault with a deadly weapon (his vehicle) on a police officer, driving under the influence causing injury and evading arrest and a misdemeanor count of resisting a police officer.

Several minutes before the fatal crash occurred, he had been pulled over by CHP officers on suspicion of speeding.  A CHP officer, at the preliminary hearing, stated that the driver had admitted that he drank alcohol and smoked marijuana all day.

The 25-year old man is in custody in lieu of $2 million bail.  If you are arrested for driving under the influence, especially if you injured or killed someone, contact an experienced Riverside County Criminal Law attorney who will provide you with extensive experience that results in a well-thought out plan of action.

A man in his 30’s lost control of his vehicle the other morning, causing it to roll over.  He was alone in his vehicle.  Officials stated that he suffered bruises, abrasions and contusions.  In addition there was the possibility of respiratory problems affecting his lung.  He was taken by helicopter to a nearby trauma center.

Police are investigating to determine what caused him to roll over; he was driving 40 mph at the time of the accident.  They may find out there was a mechanical defect or something in the road.

I urge this man to seek the guidance of an experienced Riverside County Personal Injury attorney who will investigate for him to see if he is entitled to compensation for his injuries and medical expenses.

A 49-year old Cathedral City man is facing felony charges because he allegedly was under the influence of alcohol when he lost control and crashed his SUV, killing his 55-year old passenger and critically injuring himself.  He was speeding when his vehicle jumped a curb and crashed into a tree and then came to a stop in a fence.

The driver was hospitalized for about two weeks.  Once he was released, police arrested him.  He is being charged with DUI gross vehicular manslaughter and can face between four and ten years in prison if convicted.  The driver and the passenger were not wearing seatbelts.

I hope they contact an experienced Riverside County Criminal Law attorney to discuss their options – to see if they can file a wrongful death lawsuit against the driver.
