Being charged with a hit and run offense is a serious crime that comes with severe ramifications if convicted.  Depending on the number of people injured, the severity of the injuries, and your criminal history, you can be facing jail or prison time, huge fines, probation, restitution to the victim, and points added to your driving record.

Hit-and-run accidents are not only when you hit another vehicle or a pedestrian and then flee the scene.  They also include hitting a parked vehicle and the failure to leave a note for the owner.

According to Vehicle Code 20002VC, you may be charged with a misdemeanor hit and run if you leave the scene, damage another person’s property, or not identifying yourself to the other person.  You may be charged with a felony hit and run if you injured another person.

If you are charged with a hit and run, it is important to hire an experienced and aggressive Riverside Criminal Defense attorney who will fight to protect your rights.

Did you hear about the Riverside driver whose car got stuck on the railroad tracks?  The crossing was marked as “closed for construction.”  It was lucky, though, because the driver got out of his vehicle before the train hit it.

Other motorists stopped to help him try and push the car off the tracks, but to no avail.  Can you imagine how he felt as he watched the train smash into his car, causing it to turn into a twisted pile of metal?  Again, he was lucky because he was not injured although he cannot say that about his car.  To make matters worse, he was still making payments on the car.

Reports indicate that no one on the train was injured.  However, if you are involved in an accident involving a train and you are injured, contact an experienced Riverside Personal Injury attorney to discuss your legal options.

A driver of an SUV hit a 14-year old boy while he was crossing a busy city intersection on his skateboard in Temecula recently.

The fatal accident is under investigation.  It is not clear if the boy was crossing in a crosswalk when he was hit.  According to California Vehicle Code Section 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”  The right-of-way must be yielded to not only pedestrians, but also skateboarders.

If the driver is determined to be at fault, he or she can be held liable for the young boy’s wrongful death.  If you or someone you love is injured while crossing the road, contact an experienced Riverside Personal Injury attorney who will advise you or your legal rights and options.

An 87-year old man, a World War II veteran, was in Palm Springs with his wife for a reunion.  The two were crossing a main street when they were both hit by a vehicle.

Reports indicated that the couple did not use a crosswalk.  The driver of the vehicle remained at the scene.  The man was pronounced dead about two hours later while his 83-year old wife remained in critical condition in a nearby hospital.

If a pedestrian is killed crossing outside a crosswalk, is it his fault?  California Vehicle Code Section 21950 states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection”.

California law requires the driver to prove he or she was not in the wrong.  If you have lost a loved one due to the possible negligence of another person, contact an experienced Riverside Personal Injury attorney who can investigate the case for you to determine your legal rights and options.
