Investigators are checking to see what happened to cause this fatal accident near an intersection. According to California Vehicle Code Section 21800(a), “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” This includes bicycles because bicyclists in California have the same rights and responsibilities as drivers of other vehicles.

In California, there are special laws that handle cycling under the influence. The California Vehicle Code does not include a bicycle as a “vehicle” for purposes of the California DUI laws. However, the Code does provide that it is unlawful for any person to ride a bicycle on a highway while under the influence of alcohol or drugs. Anyone arrested for this violation is required to take a blood, breath or urine test.
A conviction to the California cycling under the influence law is subject to a fine of at least $250.
The bicyclist was taken to a nearby hospital with unspecified injuries, while the driver of the hit vehicle was not injured.

The bicyclist was heading southeast on his bike when the van crashed into him. He was taken to a nearby hospital with major injuries; he died about 30 minutes later.
According to California law, bicyclists on the road have the same rights and responsibilities as motorists. They must ride in the same direction as other vehicles and as close to the right curb or edge of the road as practical.

The accident is under investigation to determine what caused it. Investigators do not believe alcohol was a factor. The report did not mention whether or not the bicyclist was wearing a helmet although according to California law, all bicyclists must wear a helmet that meets safety standards.
