An 84-year old Moreno Valley man who was standing next to his SUV at an exit on the Interstate 10 late the other night was hit by a tractor-trailer.
He was taken by air to a nearby hospital where he was pronounced dead from his injuries.
Investigators are not sure why this elderly man’s vehicle was stopped on the side of the road or why he was standing outside of it. If they determine that the truck driver was negligent in some way, or he was distracted, he could be held civilly and financially liable for this tragic death.
If a loved one was involved in a fatal accident, contact an experienced and compassionate Riverside Personal Injury attorney who has been successful in wrongful death lawsuits and can advise you of your legal rights in pursuing a claim to recover compensation for your loss.

A 30-year old man, suspected of driving under the influence in Menifee the other morning, crashed head-on into a woman’s vehicle, killing the 55-year old woman.
Reports indicate that the man, driving with his wife, drifted into oncoming traffic and then collided with the other vehicle. The man was taken to a nearby hospital where he is listed in critical condition. The wife suffered moderate injuries. Once he recovers, he will be charged with DUI and vehicular manslaughter.
I also wish the man and his wife a speedy and complete recovery. If you have been arrested for injuring or killing another person while driving under the influence, you need an experienced Riverside Criminal Law attorney to handle your case with confidence, competence and great care. Criminal convictions can derail your life and these charges must be taken seriously and acted upon promptly.

A 24-year old Beaumont Cherry Valley Water District employee was killed the other day when a stake-bed truck crashed into him.
The employee was applying street markings on the street when the truck struck him. The truck driver, an adult male, was taken to a nearby hospital for an unrelated condition, according to city officials.
The Beaumont Police Department is investigating to determine who is at fault; the truck driver has not been cited at this time. Police are asking anyone with information to call them.
I hope his family contacts an experienced Riverside County Personal Injury attorney to seek justice for his death and to determine if they can file a wrongful death lawsuit and receive compensation for their loss.

A 29-year old police officer was killed when he lost control of his squad car and crashed into a palm tree; he was chasing a parolee who was driving a stolen vehicle. The police car caught on fire; the officer was pronounced dead at the scene.
The officer, who had been a Cathedral City police officer for 18 months, had been a Marine in the Iraq War; and had earned a Purple Heart. How sad that this young hero survived a war and died chasing a car thief.
The parolee and another suspect were hospitalized with major injuries.
I hope they contact an experienced Riverside County Personal Injury attorney to see if they can file a wrongful death claim. The officer left behind a 4-week old baby.

In California, you can sue for economic and non-economic damages. Economic loss damages include past and future loss of financial support. It also includes funeral and burial expenses, plus the dollar value of lost household services. The testimony of an expert economist is helpful in determining these amounts.
Non-economic damages include the loss of companionship, affection, love, moral support and comfort – to name a few. One cannot put a price on these; all cases are judged personally.
If you are accused of wrongful death and because of the complexity of this type of action, I urge you to contact an experienced Personal Injury attorney. A wrongful death does not give the family a chance to say goodbye.

According to the OC Register, a 21-year old Cal State Fullerton student was the cause of two San Bernardino sisters dying Monday morning. The CSUF student, Jessica Shekell, was driving west in the eastbound FasTrak lanes on the 91 Freeway when she collided with a 2009 Chevrolet Silverado. The driver, Sally Miguel, 44, died at the scene. Her sister, Patricia Miguel, 30, died shortly after at the Western Medical Center in Santa Ana. Two young nieces, ages 15 and 11, were in the back seat; they were treated for major and moderate injuries and then released. None of the San Bernardino passengers were wearing seatbelts.
Jessica Shekell was treated at UCI Medical Center in Orange. She is now facing charges of driving under the influence.
I am not representing either of these parties. But I can just image that no matter what happens, whether or not the family of the victims sue for wrongful death or whether or not the attorney representing the student can mitigate the damage of the criminal charges, it is a tragedy all around. No attorney in the world can bring back the life of the loved one, or completely take away the stain of criminal action.

When someone you love dies from an illness, it is hard to cope; but, when someone dies because of wrongful death, it is devastating! California has laws to protect the surviving members of a victim of wrongful death. These same laws protect same sex partners rights in cases of negligence that results in death. A gay partner can be recognized as a surviving spouse in a wrongful death suit.
Eight years ago in San Francisco, Sharon Smith became the first same-sex partner to be recognized as the surviving spouse when her life partner died after two dogs attacked her. At the time, California’s wrongful death law limited recognition to legal spouses or blood relatives only. The judge at the trial, Judge Robertson, said, “Reading the wrongful death statute to exclude the plaintiff would unduly punish her for her sexual orientation. Such a reading has no place in our system of government, which has as one of its basic tenets equal protection for all.”
Today, California, Hawaii and Vermont are the only states that allow same-sex partners to sue for wrongful death. California Code of Civil Procedure §377.60 identifies the decedent’s surviving spouse, domestic partner and children as proper parties to bring a wrongful death. A domestic partner is defined as one who was in a registered domestic partner relationship that was established in accordance with requirements of the California Family Code.
An experienced wrongful death attorney will be able to guide you through the intricacies in bringing a case involving same sex partner rights. There is much misinformation and myth about the rights of same sex couples. Most reputable personal injury attorneys will not charge a fee for an initial consultation. It’s worth it to take the time to get your questions answered.
