A 31-year old woman, while driving on a road in Corona crossed over the center line and crashed head-on into 19-year old woman in 2008. The 31-year old woman is a former ambulance driver and emergency medical technician. The 19-year old woman died a few hours later at a nearby hospital. The woman was arrested and released on $75,000 bail. About a year later she fled to Mexico but was found by Mexican authorities and returned to the United States.
Recently she pleaded not guilty to second-degree murder, gross vehicular manslaughter while DUI and driving on a suspended license. Today she is in a Riverside County jail with bail set at $5 million. Reports indicate that the woman had been drinking at a bar prior to the accident.

An 11-year old boy was riding his bicycle one morning in Hemet when he was hit by a passing vehicle, thrown on the car’s hood and then dragged for about 25 feet. Witnesses and a nearby work crew removed the boy from under the car. He sustained burns and cuts.
Officials are investigating to determine what happened – Was the driver speeding or under the influence or just plain negligent? California Highway Patrol reports that records from 2008 indicate there were close to 400 people injured in a bicycle accident in Riverside County.
According to California Vehicle Code Section 21800(a) drivers of automobiles and required to yield to pedestrians and bicyclists who have entered an intersection of crosswalk. If the driver is found to be at fault, he or she may be held liable for medical expenses and any other expenses involved. A 40-year old man of Desert Center, was arrested by Riverside County Sheriff deputies for alleged child molestation charges after an adult female reported him. The woman stated that he molested her as a child – between the ages of 8 and 15.
The charges included unlawful sex with a minor under 14, penetration with an object and aggravated child sexual assault. The relationship between the victim and suspect was not made known. The man is being held on $1 million bail. He will have his day in court on August 30 in Indio. I suggest the man get himself a very skilled and experienced Criminal Law Attorney because the charges against him come with severe penalties and a possible prison term.

It was a busy day for U. S. Border Patrol agents when they seized more than 40 pounds of cocaine, valued at over $1 million at their checkpoint on Highway 95 in Yuma. A canine team alerted Border Patrol officers that a suspicious vehicle needed to be inspected – a hidden compartment was found under the backseat.
The drugs were turned over to the Drug Enforcement Administration for processing. If you suspect someone is transporting drugs, the Yuma Sector Border Patrol asks that you contact them at 1-866-999-8727. Friday night was a busy time for Riverside police at their DUI checkpoint on Van Buren Boulevard and Garfield Street. Not only did they arrest two people for driving under the influence and possession of drugs, but they issued 49 unlicensed drivers and/or suspended drivers. They also impounded 46 vehicles.
At the end of the evening, close to 1,400 vehicles had been stopped, checked for intoxication and unlicensed drivers. This is not only for the safety of the drivers, but for the motorists and pedestrians around them. The Riverside Police Department is hoping the people stopped and/or arrested will realize that driving and being under the influence is not safe for anyone involved.

The Press Enterprise recently reported that a Hemet police officer, age 30, was involved in a hit-and-run accident where he suffered severe injuries. Officers believe the accident was caused by a female drunk driver in a Honda Accord. Witnesses said that the other driver ran a red light, causing the police officer and himself to crash into a third vehicle already at the light.
After the collision, the female fled on foot, leaving the officer trapped inside the police car. He was later taken to a nearby hospital where he was in serious condition. The 32-year old woman, was later arrested on suspicion of felony DUI causing injuries. She violated several California laws by driving under the influence, driving through a red light and then leaving the scene of an accident.
I hope the officer recovers soon. I urge him to consult with an experienced Personal Injury Attorney to make sure his rights are protected.

For those of you who remember the tragic accident that took place last year in Anaheim when a Banning man, rear-ended a bicyclist, fled the scene and the bicyclist died a few days later – the following is an update.
The man pleaded not guilty this week to amended charges of felony vehicular manslaughter with gross negligence, felony hit-and-run, and for fleeing the scene. The police found the man’s El Camino truck soon after the accident with a shattered front windshield hidden in bushes not too far from Disneyland. The man, then on parole, turned himself into his parole officer a few days later. When first arrested, he was charged with misdemeanor vehicular manslaughter. The District Attorney’s office upgraded the charge to felony because of the disregard he showed by fleeing the scene. The man has four previous convictions which include possession of methamphetamines. He is being held in lieu of $100,000 bail and faces 13 years in prison if he is convicted.

Statistics show that teenage drivers have the highest rate of traffic convictions. Half of these drivers are arrested for some type of traffic violation in their first year of driving – the most common is speeding. Violations of laws increase the possibility of an accident happening, and worse - death. Teenagers have twice as many accidents as adult drivers. Reports indicate that this is due to lack of driving experience and the need to be the best.
If you receive a traffic ticket, there will be consequences. If you fail to pay your fine or appear at a court hearing, the DMV will suspend your driving privilege until you do so. If it is determined that you are at fault in an accident, you will receive a warning letter for the first time. A second “at fault” accident within a year - you will not be able to drive for 30 days unless a licensed adult is with you. If you are “at fault” a third time within a year - your license will be suspended for six months and you will be placed on probation for one year. A conviction for driving under the influence will cost you your license for one year.
More severe consequences are given depending on your record. You are not allowed to drive in California if your license has been suspended or revoked. If you are convicted of a traffic violation or “at fault” in an accident, it is wise if you contact a skilled Criminal Law Attorney who is experienced in traffic violations.

Did you hear about the young boy who was suspended from school when he was caught holding a $3 toy pellet gun? The young boy was waiting for the school bus when an ice cream truck pulled up. Instead of buying ice cream, he bought a toy gun with pellets and placed it in his backpack.
At the end of the day, he told a friend about the gun, still in his backpack. Word spread throughout the kids and he found himself in trouble. School officials called the Riverside County Sheriff’s Department after taking the toy gun away. The boy’s name was not released since he is a minor.
This gun was a toy, not an air-soft pellet gun. Federal law does not consider an air-soft gun to be a firearm, but the law states that a buyer must be at least 18 years old to purchase one. Any gun on a school campus violates the California Education Code Section 48900(m) and constitutes immediate suspension or expulsion. The young boy has a hearing in November and may face felony charges.

The Desert police are cracking down on drunk drivers. More and more checkpoints are being set up throughout the Palm Springs area on any given weekend. Last weekend, Indian Wells was the scene of the latest one. Over 1,300 vehicles passed through this checkpoint; one person was arrested.
The police stopped over 700 vehicles to screen them. The results included the arrest of one individual for driving under the influence of alcohol or drugs, 16 arrests for drivers with a suspended license or no license at all, nine field sobriety tests were given and 17 vehicles were impounded.
We all know that driving under the influence of alcohol or drugs is unsafe for you, the driver, and all other people on the road around you. If you are one of the foolish ones who think you can get away with driving drunk, but were arrested in the process, I would suggest you contact an experienced Criminal Law Attorney as soon as possible. The penalties on this type of offense are high.
