The Desert police are cracking down on drunk drivers. More and more checkpoints are being set up throughout the Palm Springs area on any given weekend. Last weekend, Indian Wells was the scene of the latest one. Over 1,300 vehicles passed through this checkpoint; one person was arrested.
The police stopped over 700 vehicles to screen them. The results included the arrest of one individual for driving under the influence of alcohol or drugs, 16 arrests for drivers with a suspended license or no license at all, nine field sobriety tests were given and 17 vehicles were impounded.
We all know that driving under the influence of alcohol or drugs is unsafe for you, the driver, and all other people on the road around you. If you are one of the foolish ones who think you can get away with driving drunk, but were arrested in the process, I would suggest you contact an experienced Criminal Law Attorney as soon as possible. The penalties on this type of offense are high.

A 45-year old man, ended the lives of an elderly couple (from Yucaipa) last year in Palm Springs by crashing into their car. The couple died from injuries sustained when the crash took place. The man was booked into the Banning Jail on charges stemming from the accident.
Last week, the man was charged with two counts of vehicular manslaughter. It is said that the elderly couple were in Palm Springs to watch a cap to a nuclear reactor roll through the valley on a semi-truck.
I feel so sad for the family of the elderly couple.

For those of you who do not know what a living trust is, let me explain. A living trust, also known as an inter vivos trust, is written before the creator dies. A living trust does not help assets avoid probate.
It is important to understand that signing and notarizing documents does not end the process. If you are the trust’s creator, you must visit your bank to change title and ownership of certain assets from your name to the living trust’s name. By doing this now, you can save time and effort for those taking care of your estate after your death.
Before drawing up a living trust, you must understand the people involved, which include trustees and beneficiaries. You should be aware of how to transfer assets into the living trust and the reasons living trusts are used to keep assets.
If you are considering a living trust, you should contact an experienced Estate Planning Attorney who can help you and answer any questions you may have. No one likes to think about death, but planning will save your beneficiaries aggravation and time later.

A 30-year old man, lost control of his motorcycle in Riverside recently and crashed into a pole. The impact caused him to be thrown into a street light. He was transported to a nearby hospital where he was pronounced dead.
According to a recent California Highway Patrol report, there were 32 fatalities and close to 600 injuries involving motorcycle accidents in Riverside County. The accident is under investigation to determine what caused the man to lose control of his motorcycle; investigators are checking to see if alcohol or drugs were involved or if there was a motorcycle product defect.
I hope that the man’s family consults with an experienced Personal Injury Attorney who will investigate the incident for them and make sure their rights are protected. If a defect were found to be at fault, preserving the motorcycle would be in their best interests.
My sincere sympathies go out to the man’s family for their loss.

A woman called the Riverside County Sheriff’s Department in Palm Desert the other day fearing for her life and her family. She told the officer her husband had a gun and she did not know what he would do with it. Deputies arrived and were able to take the woman and her children outside to safety.
The 38-year old man, was arrested and booked into the Indio Jail for being under the influence of a controlled substance. He was later released. There were no injuries reported.
If this happens to you or someone you know, I would advise contacting an experienced Criminal Law Attorney who can advise your next steps. No one should have to live in fear of someone else.

I have been asked if an Estate Plan ever has to be changed once it is written. The Plan should be reviewed and changed for reasons that include a marriage, a divorce or a separation. You should review your Plan if a birth or death occurs in your family. Other reasons include changes in health, assets or net worth.
If you have questions regarding creating an Estate Plan or making changes to an existing one, a qualified Estate-Planning attorney can advise you how to structure one and make sure it is implemented according to your wishes. Failure to properly draft or execute changes can cause significant problems for your family after your death.

According to The Press-Enterprise, a 31-year old woman and a 43-year old man died after crashing head-on with each other on the Ramona Expressway in Riverside. The woman, driving a Chevy pickup truck, drifted over the centerline and crashed into an oncoming Toyota driven by the man. Both died almost immediately.
California Highway Patrol records indicate that Riverside County, in 2008, had over 200 fatalities and more than 8,500 injuries due to car accidents.
This accident is under investigation to determine what caused it – numerous questions arise. If the woman was at fault, the family of the man can file a wrongful death claim seeking compensation for expenses and damages. If the vehicle manufacturer is found to be at fault, they could be responsible for all expenses and damages. I hope the man’s family contacts an experienced Riverside County Personal Injury attorney who will analyze all details of the accident. In the meantime, my deepest sympathies go out to the families of the woman and the man.

Because of the recent long Memorial Day holiday, the Blythe Police Department conducted a DUI checkpoint to reduce alcohol-related vehicle accidents. The purpose of the checkpoint is to identify drunk drivers and get them off the road. Blythe has not had any fatalities this year and they would like to keep it that way.
The Blythe Police Department believes that by enforcing awareness of the consequences of drinking and driving, they can encourage sober designated drivers. Any driver found to be under the influence of alcohol and/or drugs will be arrested.
If you have been pulled over and arrested for drunk driving, I urge you to contact an experienced Criminal Law attorney who is familiar with California DUI laws.
