Did you hear about the recent Moreno Valley 3-automobile accident on Cottonwood Avenue where one person was killed and two injured? It seems the driver of a black Honda was driving erratically – weaving in and out of traffic. It cut-off or hit a Ford Explorer, causing the Ford to swerve into oncoming traffic, hitting a Nissan minivan head-on.
The 54-year old woman driver of the Ford was taken to a local hospital where she died from injuries sustained in the accident. A male passenger in this vehicle sustained a broken ankle and the male driver of the Nissan complained of chest pains. They were taken to a local hospital and treated for their injuries. According to witnesses and investigators, the black Honda fled the scene.
Police are still investigating this accident. They ask anyone with information to contact them at 951-486-6700. My sympathies go out to the family of the driver of the Ford Explorer, a woman who was in the wrong place at the wrong time.

In a recent Orange County Newspaper article, a Riverside woman was charged with a hit-and-run death of a bicyclist in Newport Beach. The District Attorney’s office said the woman was under the influence of prescription drugs (Methadone and Clonazepam) when her SUV hit a bicyclist in Newport Beach in December.
After she hit the man, who was driving near the curb, she fled the scene – dragging his bike under her vehicle for more than a mile. The man died a day later from severe head and neck injuries.
The woman is charged with one felony count of hit and run with death, one felony count of vehicular manslaughter while intoxicated without gross negligence, and one misdemeanor count of driving without a valid license with a sentencing enhancement for causing great bodily injury.
Once again, I urge you not to drink and drive or while taking medication. This woman needs the help of an experienced Criminal Attorney.

A hit-and-run driver who allegedly caused a multi-vehicle crash in Murrieta that killed three people has not been found. A small group recently gathered to mourn the loss of a young girl and her uncle who were among the victims killed. The girl was due to graduate from 5th grade in June.
Police are looking for a man reported to have been driving erratically in the area. The mother of this young girl is hoping the driver will come forward. Police are looking for a black Honda or Acura with tinted windows and spinner wheels driven by a white male about 20-25 with short dark hair, clean-shaven and a tattoo on his left forearm. The description was given to the police by an eyewitness.
The police are asking for anyone with information to step forward and call 951-769-2000.
How sad for the family of these victims.

Talk about identity theft. A Palm Springs man was sentenced with a year of probation, ordered to undergo mental health counseling and a $250 fine after he was charged with impersonating a U. S. Marine. He was wearing medals he never earned.
The U.S. Attorney’s Office stated that the man arrived at his 20-year class reunion dressed as a Marine covered with all types of medals, including the Navy Cross, Bronze Star and Purple Heart. The FBI said he wore a lieutenant colonel’s insignia and told friends he spent a career in the service. One of his classmates, a U.S. Navy commander made an official inquiry and discovered the man was never in the Marines or any branch of the Armed Forces.
The 39-year old pleaded guilty to a federal misdemeanor charge recently after violating a federal statute that prohibits the unauthorized display of military medals. It seems he purchased most of the medals on eBay and a military surplus store.
His attorney is claiming that because of the media, he lost his job as an information technology specialist at a local bank.

Roads in California always have vehicles on them. This includes passenger cars, trucks, motorcycles and bicycles. With all these vehicles in a rush to get somewhere, no wonder there are collisions occurring all the time. At any time, one can witness a near miss, impatient or distracted driver. Everyone seems to be in a hurry.
If you travel through the north end of the Coachella Valley, you will notice ten new signs along the unofficial bike routes that urge motorists and bicyclists to “Share the Road.” The Desert Bicycle Club and the Riverside County Department of Transportation worked together to come up with these signs with help in the way of a $1,800 grant from the Desert Healthcare District.
The purpose of these signs is to alert motorists that bicyclists use these roads and to drive safely. The signs also remind bicyclists to obey the rules of the road. Most of the roads have only two lanes and no separate bike lanes.

For those of you who think dealing in drugs is the way to go – think again. Let me remind you about The Palm Springs Police Department and the recently formed Narcotics Task Force. These officers work with the Federal Drug Enforcement Administration and the Federal Bureau of Investigation plus other local law enforcement agencies.
The purpose of the Narcotics Task Force is to combat all the drugs that come through the Coachella Valley. The Palm Springs area is a tourist area where partying goes on all the time. If you have been arrested for drug use or selling drugs, I urge you to contact an experienced Criminal Attorney. This is a complex matter and you can end up in jail unless you have a skilled attorney on your side.

If you were arrested for being drunk in public, let me refresh you on the California Penal Code 647(f). This law prohibits being drunk in public. According to this law, you are considered drunk in public “if your level of intoxication makes you unable to exercise care for your safety or for the safety of others, or your level of intoxication interferes with, obstructs, or prevents others from using streets, sidewalks, or other public ways.”
If you are convicted of this offense, you will face fines, jail time and probation. A conviction will be placed on your permanent criminal record. A skilled Criminal Attorney can offer you a defense, which may reduce or dismiss this conviction. This is a serious offense; do not delay in hiring an experienced Criminal Attorney to protect your rights.

In California, you can sue for economic and non-economic damages. Economic loss damages include past and future loss of financial support. It also includes funeral and burial expenses, plus the dollar value of lost household services. The testimony of an expert economist is helpful in determining these amounts.
Non-economic damages include the loss of companionship, affection, love, moral support and comfort – to name a few. One cannot put a price on these; all cases are judged personally.
If you are accused of wrongful death and because of the complexity of this type of action, I urge you to contact an experienced Personal Injury attorney. A wrongful death does not give the family a chance to say goodbye.

You need to sit down with an experienced Estate Planning Attorney to protect your money in case you or your spouse must reside in a nursing home. Your attorney will see if you are eligible for Medi-Cal. Medi-Cal will pay for the cost of nursing home care, which can range from $4,000 to about $6,000 each month.
If you are 65 or over, disabled, or blind, you will be eligible for these benefits. However, you must meet certain income requirements also. The requirements for a single individual include no more than $2,000 in non-exempt assets and you cannot keep more than $35 each month in income. For than $35 in income requires you to pay for part of the cost. A married individual can have the $2,000 in non-exempt assets and his or her spouse can retain some. The same rules apply to the income (includes the spouse). An individual collecting Medi-Cal benefits is allowed to have assets such as a home, items in the home, an automobile, etc.
Benefits for Medi-Cal can be denied if the individual transfers assets to another person, this can be considered a Federal crime. An experienced Estate Planning Attorney can guide you through all planning strategies and determine what is best for you, especially if you need to live in a nursing home.
